Eb-3 (Employment based visa)

Living and working in the USA continues to be a strong draw, but what requirements do you need to be successful under the Eb-3 visa category?

Key requirements
The most common route to permanent residency is through the Eb-3: for 'skilled' or 'professional workers' with a bachelor's degree or, amongst other things, two years training or experience. The typical EB-3 applicant is already a temporary resident in the US under another visa category such as the H1-b (as a speciality worker in a profession in which the US is experiencing a labour shortage), or an L-1 (AS an intracompany transferee when the applicant is an employee of a foreign company with a parent company in the US). In most cases, a job offer and labour certification will be required which can be complicated to obtain.

Processing time
Labour certification used to take up to two years but Programme electronic review management (PERM) is cutting waiting times to closer to 60 days. L-2 visas allow the immediate family of L-1 recipients to work and live in the US.

Eb-1: priority workers
Eb-2: professionals with exceptional ability
Eb-4: religious and government workers, other H-class visas: skills shortages.
